Agreement to Terms

By accessing our website at loyalto.store or placing an order with Loyalto, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our site or place an order.

These terms apply to all visitors, customers, and others who access or use our website and services.

Products and Custom Orders

All Loyalto products are custom-made to order. Each order is personalized with the specific photo, name, and dates you provide at the time of purchase. Because of this, every order is unique and non-transferable.

By placing an order, you confirm that:

• You are the owner of, or have the right to use, the photo(s) you submit
• The personalization information you provide (name, dates) is accurate to the best of your knowledge
• You understand that custom orders cannot be returned or refunded once production has begun, except as described in our Shipping & Returns policy
• You are at least 18 years of age or have the consent of a parent or guardian

Pricing and Payment

All prices are listed in US dollars. Prices are subject to change without notice, but the price displayed at the time you complete your purchase is the price you will be charged.

Payment is processed securely by Shopify at the time your order is placed. We accept all major credit cards and any payment methods offered through Shopify's checkout. We do not store your payment information on our servers.

Sales tax may be applied depending on your location, as required by applicable law.

Photo Submission and Review

When you submit a photo for your custom order, you grant Loyalto a limited, non-exclusive license to use that photo solely for the purpose of producing your order. We will not use your photo in advertising, share it publicly, or transfer it to any third party outside of the production process.

We reserve the right to contact you before production begins if your submitted photo does not meet our technical requirements (resolution, lighting, crop). In that case, we will give you the opportunity to submit an alternative photo before we proceed.

We reserve the right to decline orders that contain photos we determine to be inappropriate, offensive, or in violation of these terms. In such cases, a full refund will be issued.

Intellectual Property

All content on this website — including text, design, graphics, logos, and images — is the property of Loyalto and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this site without our prior written consent.

The Loyalto name, logo, and taglines (including "Forever Loved. Forever Lit." and "Leave the Light On") are proprietary to Loyalto and may not be used without permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Loyalto and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products, including but not limited to:

• Loss of data or submitted photos
• Delays in production or shipping due to circumstances outside our control
• Dissatisfaction with color rendering or material appearance beyond what is described on our product pages
• Errors in personalization resulting from information you provided

In no event shall our total liability to you for all claims arising out of or relating to your order exceed the total amount you paid for that order.

Nothing in these terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

Disclaimer of Warranties

Our website and products are provided "as is." We make no representations or warranties of any kind, express or implied, regarding the accuracy of content on our site or the fitness of our products for any particular purpose, beyond what is expressly described on our product pages.

We do our best to represent our products accurately, including the quality of photo transfer, the warmth of the LED glow, and the materials used. If your order does not match what was reasonably described, contact us — we will make it right.

Governing Law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of our site or products shall be resolved through good-faith negotiation first. If a resolution cannot be reached informally, disputes shall be subject to binding arbitration in accordance with applicable arbitration rules, or resolved in the appropriate courts of the United States.

Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes take effect immediately upon posting to this page. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.

The "Last updated" date at the top of this page reflects when these terms were most recently revised.
